Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EMO Pulse™ platform, including all related services, features, and applications (collectively, the "Service"), operated by EMO Pulse™ ("Company," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using EMO Pulse™, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a school, district, university, or organization, you represent that you have the authority to bind that entity.

EMO Pulse™ is a social-emotional wellness platform designed for K-12 schools, universities, and corporate teams. The Service provides:

To use the Service, authorized personnel must create an account. You agree to:

School and district administrators are responsible for managing user accounts within their organization, including student, staff, and guardian accounts.

4. Student Accounts and Minors

Student accounts for users under 13 require verifiable parental or guardian consent in compliance with the Children's Online Privacy Protection Act (COPPA). Schools acting as agents of parents may provide consent in accordance with COPPA's school consent exception. For students aged 13-17, schools may create accounts as part of their educational program.

6. Subscription and Payment

6.1 Free Pilot

New schools and organizations may access a 30-day free pilot with full platform features. No credit card is required. Extended 90-day pilots are available upon request.

6.2 Paid Licenses

After the pilot period, continued access requires an annual school or district license. Pricing is based on the selected plan. Payment is processed through Stripe, our third-party payment processor.

6.3 Refunds

Annual licenses are non-refundable after the first 30 days of the paid term. If you are unsatisfied within the first 30 days of a paid license, contact us for a full refund.

7. Data Ownership

Schools and organizations retain full ownership of all data entered into the Service, including student check-ins, journal entries, assessment results, and administrative records. EMO Pulse™ does not claim ownership of your data. You may export or request deletion of your data at any time.

8. Intellectual Property

The Service, including its design, code, features, content, THRONES™ framework, and branding, is the intellectual property of EMO Pulse™ and is protected by copyright and trademark law. The EMO Pulse™, ClassEMO™, THRONES™, and Harmony Hub™ names and marks are trademarks of EMO Pulse™.

Your license to use the Service is limited, non-exclusive, non-transferable, and revocable. You may not copy, modify, distribute, or create derivative works from any part of the Service.

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Our data practices comply with FERPA and COPPA requirements for educational institutions.

10. Service Availability

We strive to maintain 99.9% uptime. However, the Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. EMO PULSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Crisis and Safety Features

EMO Pulse™ includes crisis protocol features and an "I Need Help Now" button that connects users to external crisis resources (such as the 988 Suicide & Crisis Lifeline). These features are provided as informational tools and do not constitute professional counseling, therapy, or emergency services. Schools remain responsible for their own crisis intervention protocols.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMO PULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless EMO Pulse™ from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

Either party may terminate the agreement at the end of the current subscription term. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, you may request export of your data within 30 days, after which it will be permanently deleted.

16. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers of material changes at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
